1. Eligibility

You must be at least 16 years old (or the minimum age in your country that allows you to consent to data processing).

If you are under 18, you may use the Service only with the consent of a parent or guardian.

You may not use Matchya if you are prohibited from using such services under applicable laws.

2. About Matchya

Matchya is an AI-powered wellness companion. It provides general emotional support, lifestyle suggestions, and conversational guidance.

Matchya is NOT:

• A medical or mental health service
• A therapist, doctor, clinician, or crisis resource
• A replacement for professional advice

Matchya does not diagnose, treat, or prevent medical or psychological conditions.

If you are in crisis or need immediate help, contact local emergency services or a crisis hotline.

3. User Responsibilities

You agree to use Matchya responsibly and not for:

• Illegal activities
• Harassment, abuse, or threats
• Uploading harmful, obscene, or misleading content
• Attempting to access or reverse-engineer the system
• Sending viruses or harmful code

You are responsible for:

• Maintaining the security of your device and account
• Providing accurate information
• All activity that occurs under your account

We may suspend or terminate your access if you violate these Terms.

4. Your Content

By using the Service, you may input text, voice, or other materials ("User Content").

You retain ownership of your User Content.

By providing it, you grant Matchya a non-exclusive, worldwide license to process and use the content only to operate, improve, and maintain the Service.

We do not sell your User Content.

We may use aggregated or de-identified data to enhance and analyze service performance.

5. AI-Generated Output

AI responses are generated automatically and may be inaccurate, incomplete, or inappropriate.

By using the Service, you acknowledge:

• AI outputs are not reviewed by human professionals
• You should not rely on outputs for medical, legal, financial, or safety-critical decisions
• You are responsible for evaluating the information provided

Matchya disclaims all liability arising from reliance on AI-generated content.

6. Subscriptions & Payments

Some features require a paid subscription ("Premium"). Payments are processed by authorized third-party providers.

By subscribing:

• You agree to the pricing shown in the app
• Subscriptions automatically renew unless canceled
• Cancellation can be done anytime via your App Store or Google Play settings
• Fees are non-refundable unless required by law or platform policies

We may update pricing, and changes will be communicated in advance.

7. Third-Party Services

Matchya uses third-party providers such as:

• OpenAI – AI responses
• Supabase – data storage
• Clerk – authentication

Your data is shared only as necessary to operate the Service.

Use of these services may be subject to their own terms.

8. Privacy

Your use of Matchya is also governed by our Privacy Policy, which explains how we collect, use, and safeguard your data.

By using the Service, you consent to our data practices as described in the Privacy Policy.

9. Termination

We may suspend or terminate your access at any time if:

• You violate these Terms
• You misuse the Service
• We discontinue or modify the Service

You may stop using Matchya at any time and/or delete your account within the app.

Certain sections (like disclaimers, liability limits, and governing law) continue to apply after termination.

10. Limitation of Liability

To the fullest extent permitted by law:

• Matchya is provided "as is" and "as available."
• We make no warranties of accuracy, reliability, or suitability.

We are not liable for damages arising from:

• Use or inability to use the Service
• AI-generated outputs
• Loss of data
• Unauthorized access due to circumstances beyond our control

Total liability, if any, is limited to the amount you paid in the past 12 months.

Some jurisdictions do not allow certain exclusions, so these limitations may not apply to you.

11. Indemnification

You agree to indemnify and hold Matchya harmless from any claims arising from:

• Your use of the Service
• Your violation of these Terms
• Your content or interactions within the App

12. Modifications to the Service

We may change, update, or discontinue any part of Matchya at any time.

We will notify users of major changes when reasonable.

13. Governing Law & International Use

These Terms are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada that apply in Ontario, without regard to conflict of law principles.

If you access the Service from outside Canada, you are responsible for complying with local laws. Matchya does not represent that the Service is appropriate or available in all locations.

Dispute Resolution

Any dispute, claim, or controversy arising from or relating to these Terms or your use of the Service will be resolved in:

Unless applicable consumer protection laws in your country require that disputes be handled in your local jurisdiction.

14. Updates to These Terms

We may revise these Terms periodically.

When changes are made, we will update the "Last Updated" date and may notify you through the app or email.

Continued use of Matchya means you accept the updated Terms.
